Texting The Driver

You're texting back and forth with a friend. You don't know it, but he's behind the wheel of his car as he's having this conversation with you. Then he's isn't paying enough attention to the road, he crosses over the double yellow line and plows into a couple coming the other way on a motorcycle.

Are you partly responsible? Should you have known he was driving and you were distracting him? Two judges in a New Jersey appeals court said so in a decision handed down last week -- but attorney and legal analyst Scott Sherman told me on America Weekend that he can't find any basis in law for what the judges wrote. Will their words have the force of law? Could this affect other cases around the country?
